You know it is suits like this that will ultimately get the govt in place as the tracker of these thieves, instead of private organizations.  And since they can be exempted from things like end user agreements and prohibitions against reverse engineering in order to track and capture thieves (just as they do in the regular 'analog' world - ie wiretaps, search warrants, etc etc), all this means is private property owners will put more and more pressure on the govt to do something about such property rights violations because they as individuals cannot.

So rooting against the RIAA is ultimately rooting FOR the Justice Dept (along with the FBI, and all state and local govts) to come in and do the same thing (or worse).

So keep at it - you will get what you deserve in the end. ;)

No you fool, rooting against the RIAA is the best thing to do. Maybe we will get the DMCA marked unconstitutional, so their broad range of powers like subpoenaing powers would taken away. Stop with this government bullshit your always taking about, cause your talking about the wrong law, your looking for the Patriot Act, not the DMCA, the DMCA is only used for IT industry. Guess what with the DMCA in place you don't have to go before the Judical Branch anymore. That's why the RIAA is suing 12 -year-olds. They don't have to get their identity either.

How come RIAA hasn't sued the maker of kazza?

:s10: You tell me.  You'd think that would be the first thing the RIAA would have done. :s8:

It was.  They lost.  It aint Sharmans fault nasty nasty people use their program to share files protected by copyright.

Oh sheesh, never hurd of that.  How could they have lost?

What are the makers of Kazaa doing that is wrong exactly?  They provide a way to share files with many users over the internet. What is wrong in that?

NERO make software to copy CD's, should they be sued because some people use it to ILLEGALLY copy cd's?? No! Its exactly the same with Kazaa, just because the USERS commit offences does not mean the MAKERS are to blame.

Agree... But the stats show that people in larger % use Kazaa to illegaly share file under copyright blah blah blah...

While, if I do a backup copy of EF with my burner, it's legal.

Hah.  No way in heck am I reading that...  But I am drawn to this thread... Much the same morbid way that people are drawn to car crashes or bum fights.

because technically its not theft of property.  the RIAA doesn't sell MP3's. and they didn't make the MP3's which are being shared. so criminal law doesn't support the RIAA's position ; nothing was actually "stolen" from them.

instead they are claiming that copyrights were violated when the files were shared on Kazaa*
so they are suing in civil court, to protect the "intellectual content" of the MP3s.
(and they are using a law which was written to protect software**,
to justify violations of privacy, against private citizens)

---------------------------
* opponents feel that the copyrights were only violated when the files were made.
(or not.. since most people only rip discs they own)
(and its legal to make copies for yourself if you want to)
---------------------------
**this is what TAK (Peaceable Frood) has issues with.

the only ppl who really should be able to sue is the artists of the music, the people who paid for the copyright, and if the artists dont agree then its really fine,RIAA is actually stealing money which the artists should get if they want to sue,

the RIAA is a trade group which acts on behalf of the record labels.
the record labels own the recordings. not the artists.

if the artists don't like whats going on ,
they can just refuse to sign those multi-million dollar recording contracts.
(ya right)
