cant you use copyrighted music, but when you start getting money because of it, thats when it becomes illegal?

Um, no.

Think about all the problems with peer-to-peer sharing....it has nothing to do with money but everything to do with unauthorized copying and use of someone's copyrighted work.

Just a thought, but most "russian" music, as in - from the Soviet era - is royalty free.

And all thanks to Communism!

Cool, eh comrade?

[cool]
[casanova]

On a copyright note.

Total intellectual copyright lasts for 75 years after the composer's death - if his work was restricted by copyright original (not under communism).

However, there is "acceptable usage" --- which to be honest is a legal minefield.

So if you are going to use copyrighted intellectual property, for a non-profit purpose, you should first ask, they don't actually have to reply for you to use. But should they ask you to "cease and dissist" it's that or get sued.

Anyhow, as I said, LEGAL MINEFIELD.

So if they've been dead for 75+ years, it's a free-for-all.

And there is a lot of communist era tunes out there which are exempt from copyright. Great for the "russian vibe".

Eh comrades, eh?
[tongue]

P2P fell foul because they were people getting the music who would have otherwise paid for it as a product. Like Virtual shoplifting.

This is not the same as "fair use" - but again, Legal Minefield.

From what I understand, the music belongs to one person. If they have been dead for 75 years, its free. But, and I say but, no matter how long where you think you stand, it's always best to check things like this out. You don't want toi end up in a bad position just for a bit of music.

all laws put aside, do you think that the people who own copyright to the songs are going to go around looking for it being used in COD2 mods? Im not saying this as an insult, just a general question. I dont think your mod is going to get mainstream realease and be advertised on tv where thousands of people would see it, then a recording company finds out that you are using copyrighted music in it. Im sure that the people who play your mod isnt going to go squeal on you. What about the hundreds of First-Person-Shooter music videos out there(I know a music video is different from a game mod, buts the subject im using it on is pretty much the same) I havent seen all of them, but im sure they have copyrighted music in it and did not compose it themself. I myself have made a music video or few with the music of a favorite band playing in the backround. Is a record lable going to send me a private message and try to sue me because I just admitted to using copyrighted music on a homemade video? No, why? because its higly unlikly that they are searching around these kind of forums for that kind of stuff

K, cause I allready knew that if you are making a mod you can't make any profit out of it. But my basic problem is that i dont want any problems if I use music like the russian songs of James Horner. I still don't think i get any problems but im still not 100% sure of it. [thumbs_up]

James Horner. Sony Music. [devilishgrin] BIG LAWYERS. [evil]

Let me put it like this. Over at Codfiles you can get the theme to the new King Kong movie to download and when you install the pk3 it plays it instead of COD2 menu music in game. No one seems bothered about hosting it over there.

Look, you probably wouldn't get any trouble cos these people have bigger fish to fry, at worst a "cease and dissist" order because it is for non-commercial use. But you wouldn't even get that, it'd be to the sites hosting it.

No one will come and get you for doing it, but give proper accreditation in your readme of the source.

never fear, own soldier is here.

Hi friends, its been awhile since the spr mod. I have a touch of time to write some music for the mod. I have been writing music for the game Battle for Wesnoth and the new music should be in the 2nd edition of this game.

let me know if you need me...
p.s. what ever happened to that spr mod anyways?
