This has been previously reported here, and as I stated in the original thread Quote: StrYdeR writes

as you do not technically own any intellectual property, you cannot claim copyright infringement - as you cannot copyright something that you do not own
i stand by previous comments, and anyone that charges for a mod is asking for legal trouble
if you feel that you have been legally wronged take it before the judicial system - though i feel that you will get the same response, and it would cost you to get it.
-or-
release all the files for free and then whoever is trying to make money from your work can no longer financially benefit from it.

This cod community is and has always been about sharing and I fear that foolish people might have paid for your server side files at the crazy price of $130
your final statement says it all and what you really think of this great site that gives it all for free year in year out.

I'm aware that Activision/IW own my work as derivative work of them.
The models used in my mod are still owned by Activision/IW.
But, Fabio (or anyone else) is not Activision/IW. He has no right to touch my work, especially what I created all by myself.
Not only me, many other modder's work was/are being stolen by Fabio. (ex: MODS Zombies V3, originated by brax, phpcod). I think that's why from CoD 4, modder's works are protected from other modders: only Activison own the work.
To conclude, Activision owns my mod, not Fabio. Therefore Fabio has no right to touch my mod.
